MINUTES of Haxby Town Council Planning Committee Meeting held on Monday 7th March 2022 in The Council Office, Memorial Hall, Haxby, at 18.30.

            RESOLVED that the minutes of the meeting held on the 4th of February 2022 to be confirmed as a true and accurate record.

Single storey extension to front and side, single storey extension to front to form new entrance lobby, replacement of windows and doors to front and side, 2no. additional roof lights to rear, replacement of existing timber fascia’s, soffits and UPVC rainwater goods and 2no. new render panels to front. Erection of low height retaining wall with railings and formation of terrace to rear.

The Council discussed this proposal at the last meeting, where the Council had no objections, and have nothing further to add.

The Council has no objections.

The Council has noted concerns raised by a neighbour regarding the height of the fence.

RESOLVED, that this Council objects to this application on the following grounds:

  1. Overdevelopment of the site.
  2. The extension was cramped and was close to the boundary of No 4 Redwood Drive.
  3. This was not in keeping with the existing development.
  4. This facility will be detrimental to existing and future residents of No 8 Redwood Drive.

Any approval must be to the regulations of “The Foss (2008) Internal Drainage Board report ref: PR21/0617 dated 22 February 2022 by Bill Symons, Clerk to the Board.

The Council requested a comment from the City of York Planning Office in relation to concerns regarding application 22/00083/FUL at 40 York Road, Haxby. Haxby Town Council that asked.

The Council are very concerned that in section 5 of the application form – ‘New dwelling following part demolition of existing building’ has resulted in approximately 95% of the original building being demolished without prior planning permission. This Council feel this is a flagrant abuse of the planning system and request the City of York’s planning officers’ views of this breach. The Council has no objections to the actual application.

The City of York Council replied,

“The City of York Council confirmed that the scheme is in essence the same proposal with regards to its appearance as the previous application at 40 York Road. The reason for the new application is down to the applicant demolishing the existing house, no details of this were provided as part of the previous householder application. From their understanding, the applicant felt that by maintaining 2 walls of the original dwelling it would still be classed as extensions to the existing structure. The City of York Council disagreed with this assessment and felt that enough of the existing dwelling had been demolished for this to be deemed as a rebuild rather than extensions to an existing dwelling. Once the demolition works had been brought to our attention the applicant was informed, they will need to seek planning permission for a new dwelling even if it is to be built in accordance with the previously approved plans. The new application is now to be assessed as a new dwelling rather than extensions to an existing building”.

RESOLVED that the next meeting of the Haxby Town Council Planning Committee will take place on Monday 4th April 2022 at 18.30 hours in the Haxby Town Council Office.

There being no further business the meeting closed at 19.08 hours.
